Tougher rules and guidelines

The Polish Supervisory Authorities have imposed tougher rules and guidelines on Polish Insurers and Green Card Claim Handlers for the handling and settling of Third Party Motor Claims. This brings the protection of victims more in line with Western European standards. On the other hand, the new rules will also have considerable implications for claim handling in Poland.

This brings the protection of victims more in line with Western European standards. On the other hand, the new rules will also have considerable implications for claim handling in Poland.

Consequences of the new rules and guidelines
By imposing these rules, Poland aims at substantially improving the position of victims of traffic accidents. The new set of rules applies since April 1st this year and includes strict time limits for claim settlement, guidelines for communication with a claimant, the handling of complaints and minimum requirements for the competencies of claim handlers. As a result of these new rules, the industry expects a 20% increase of claims in numbers and a 30% increase of claim costs.

Insight in the increase of costs
In case of vehicle damages, the new guidelines entitle claimants to claim costs for a replacement car from the date of accident until the date of settlement of their claim. Obviously, this may cause substantial costs for the insurer. Victims can also claim for a diminished value of the car after the accident. Furthermore, insurers and claim handlers are required to warrant that in case of repairs replacement parts are at least equal to the original equipment manufacturer parts in terms of kind, quality, safety, fit and performance. In the past Insurers would only pay for the use of second hand parts.
